Agreement

1. Customer may not sell via third party websites, including but not limited to, Amazon.com and eBay.com. Violation of this policy will result in immediate termination of Customer’s account and Customer will be liable for damages and attorney’s fees. In the event of litigation resulting from a severe violation, all litigation will occur in Rockford, IL. Additionally, Serola reserves the right to repurchase any remaining inventory from Customer at the price paid to Serola, less a restocking fee of ten (10%) percent.
2. Customer shall inspect all shipments from Serola Biomechanics, Inc. upon receipt. Any claim for incorrect quantities, damaged or non-conforming products shall be made to Serola Biomechanics, Inc. within ten (10) business days of receipt or be deemed waived.
3. No contrary terms, including those on Customer’s purchase orders, will negate any terms of this agreement.
